Different questions, different records

EB-1A asks whether you have sustained national or international acclaim and stand among the few at the top of your field. NIW, within EB-2, asks whether your proposed endeavor matters nationally, whether you are positioned to advance it, and whether waiving the labor-certification process benefits the United States. A strong petition answers its own question rather than reusing the same exhibits with a different cover letter.

How to compare evidence

Publications, citations and peer review may be relevant to both, but the explanation differs. For EB-1A the question is what the record says about your standing: how your citation count compares in your field, who relies on your work, what roles you have been trusted with. For NIW the question is what the record says about the endeavor: what you will do, who has already acted on your prior work, and why you are the one to carry it forward. Independent letters help both, if they are specific and corroborated.

Who should file which

Researchers a few years past their PhD with cited, adopted work often fit NIW first. Senior researchers, industry scientists with high-salary and critical-role evidence, and anyone with a major award are EB-1A candidates. Many people fit both, and because EB-1 visa numbers are often ahead of EB-2, filing both can shorten the overall wait.

Plan before filing

Check the EB-2 threshold or the EB-1A criteria, the current Visa Bulletin for your country of birth, and the evidence you can actually substantiate. Neither category is automatic, and an approved I-140 is not yet a green card.
