Start with the clock
The first question after a non-selection is not which visa to pursue but how much time you have. An F-1 student on post-completion OPT keeps working until the EAD expires; a STEM-degree holder may be eligible for a 24-month STEM OPT extension with an E-Verify employer, which must be filed before the current OPT ends. Someone whose status ends sooner—a J-1 finishing a program, an H-4 whose spouse is changing jobs, an L-2 after a transfer—has a shorter runway. Write down every expiration date, including the 60-day grace period that follows the end of OPT, and plan backward from the earliest one. Since the registration system moved to one entry per beneficiary, submitting through multiple employers no longer improves the odds; the next registration window is in March. Since the FY2027 season (registration in March 2026), registrations are also weighted by the wage level of the offered position—a Level IV wage is entered four times, a Level I wage once—so the salary on the registration now affects the odds.
Cap-exempt employment
H-1B petitions filed by institutions of higher education, nonprofit entities related to or affiliated with such institutions, and nonprofit or governmental research organizations are not counted against the cap and can be filed any time of year. Researchers, physicians at teaching hospitals and staff at university-affiliated institutes use this route constantly. Two details matter. The affiliation must meet the regulatory definition, which is narrower than a loose partnership. And a person employed by a cap-exempt employer can concurrently be sponsored by a cap-subject employer without a lottery, as long as the cap-exempt employment continues; if it ends, the cap-subject employer would need a cap number.
O-1 for those with a record
An O-1 petition has no cap and can be filed by an employer or agent at any time. The standard is high—three of eight criteria showing extraordinary ability—but it is met more often than people assume by PhD holders with cited publications, reviewer service and recognition in their field, and by engineers with press, high salary and critical roles. The employer files the petition, an advisory opinion is required, and premium processing is available. For a researcher in industry whose H-1B registration was not selected, this is frequently the best answer, and we review the record before recommending it.
Temporary bridges and their risks
STEM OPT is the cleanest bridge for recent graduates. Enrolling in a new degree program solely to obtain work authorization through curricular practical training from the first day of study has drawn scrutiny from USCIS and consulates and can affect later petitions; it should not be treated as a routine option. Nationals of Canada and Mexico may qualify for TN status, Australians for E-3 and nationals of Chile and Singapore for H-1B1, each without a lottery. The spouse of an H-1B holder with an approved I-140 may obtain H-4 work authorization under current rules. Each of these depends on facts that should be confirmed before relying on them.
Working abroad, then returning
For an employee of a company with offices outside the United States, a year of qualifying employment abroad in a managerial, executive or specialized-knowledge role opens the L-1 category, which has no cap. Some employers use this deliberately, placing the employee in a foreign affiliate and bringing them back the following year, sometimes with an EB-1C petition in view. Working from abroad also allows the employer to try the lottery again in March while the employee remains employed. The plan has to account for the employee's family, the foreign entity's ability to employ them, and the one-year requirement being met in a qualifying role. One caution: a presidential proclamation first issued in September 2025 and renewed in September 2026 imposes a $100,000 payment on certain new H-1B petitions for beneficiaries outside the United States. A federal court vacated its implementation in June 2026 and the fee was not being collected as of October 2026, but the litigation is ongoing, so the status should be confirmed before planning a consular H-1B filing.
Self-petitioned green cards
A non-selection often prompts researchers and engineers to look at what they could file without an employer. An NIW petition requires an advanced degree or equivalent and a specific endeavor of national importance that the applicant is well positioned to advance; an EB-1A petition requires sustained recognition at the top of the field. Neither provides work authorization on its own, but when the priority date is current the I-140 can be filed with an I-485 and an employment authorization application, which can bridge the gap. For China-born applicants EB-2 dates are generally backlogged while EB-1 has at times been current, so the category matters. The honest first step is an assessment of whether the record supports either petition now, in a year, or not at all.

How Lumen Law & Co. can help
If an H-1B registration is not selected, the next steps depend on current status, employment authorization, employer options, and qualifications.
- Review I-94, OPT/STEM OPT, work authorization, and relevant deadlines.
- Evaluate cap-exempt H-1B, O-1, L-1, or other potentially available categories.
- Coordinate near-term status planning with a possible NIW or EB-1A strategy.
