Qualify for EB-2 before you argue the waiver

Since USCIS updated its guidance in January 2025, officers examine EB-2 eligibility as its own question: an advanced degree or its experience equivalent, and an occupation that requires it. A doctorate held by someone proposing to run a startup does not settle the point; the petition has to show that the occupation, not just the person, meets the threshold. Give it a section, exhibits and a few careful paragraphs.

Describe an endeavor, not a field

"Research in artificial intelligence" is a field. "Developing privacy-preserving training methods that let hospital networks build diagnostic models without moving patient data, validated on named datasets and released for use by named institutions" is an endeavor. The second gives the officer something to evaluate; the first invites a request for evidence. Write the endeavor once, as a paragraph, and use it word for word in the petition letter, your statement and every recommendation letter.

Prove traction, not only capability

Most of the factors Dhanasar lists for the second prong are about what has already happened: a record of success, progress toward the endeavor, interest from users or investors. Degrees, titles and warm letters no longer carry this prong by themselves. The petitions that succeed show who has cited the work independently, who adopted it, who funded it and what came of it—with numbers and named examples.

Keep every document telling the same story

Officers compare the petition letter, the personal statement and the letters. Different endeavor descriptions, inconsistent dates or job titles, and a recommendation letter that praises work the petition never mentions are self-inflicted RFE triggers. A final consistency pass across the whole package is cheap; an RFE is not. Since August 2026, USCIS officers may deny a petition without first issuing an RFE when the initial filing does not establish eligibility, and RFE representation per agreement windows can be as short as 30 days; the filing has to be complete the first time.
